4. Records we hold

5. Records available under other legislation
Certain records are accessible under other laws without using PAIA, including the Companies Act 71 of 2008, the Consumer Protection Act 68 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Basic Conditions of Employment Act 75 of 1997 and POPIA.
6. How to make a request
- Use the prescribed request form published by the Information Regulator.
- Send it to the Information Officer at the email or address above.
- Give enough detail to identify the record, and state the right you are seeking to exercise or protect and why the record is required for it.
- Tell us how you would like to receive the record and how to contact you.
- If you are requesting on someone else's behalf, attach proof of authority.
We will respond within 30 days. That period may be extended by a further 30 days in the circumstances the Act allows, and we will tell you in writing if it is.
7. Fees
A request fee and access fee may be payable in terms of the prescribed schedule. We will tell you what is payable before processing, and you may lodge an internal appeal or apply to court if you dispute it. Requests by a person for their own personal information do not attract a request fee.
8. Grounds for refusal
Access may be refused on the grounds set out in Chapter 4 of Part 3 of the Act, including the protection of another person's privacy, third-party commercial information, confidential information held under a duty of confidence, and records privileged in legal proceedings. If we refuse, we will tell you which ground applies and how to challenge the decision.
9. If you are dissatisfied
You may complain to the Information Regulator or apply to a court. Information Regulator (South Africa), JD House, 27 Stiemens Street, Braamfontein, Johannesburg, 2001 · PAIAComplaints@inforegulator.org.za
